Course Description

Real Estate Practice deals with the practicalities of selling and buying real estate.  This is done by way of a role play in which students play the roles of either a seller's or a buyer's solicitor.

Students can choose to study Real Estate Practice as it applies in the ACT, NSW, NT, Queensland or Victoria.

This course is a compulsory component of the Graduate Diploma of Legal Practice.

Learning Outcomes Upon completion of the course, students should:
  • understand the practical aspects of Real Estate practice
  • demonstrate skills in legal writing, legal drafting, negotiating, file and time management
  • understand what is required when acting for sellers and buyers of a property
  • demonstrate reflective practice about their performance in the role-play conveyance.
Indicative Assessment In summary the assessment for this course consists of the following:
  • drafting an initial letter of advice and costs agreement
  • a conveyancing role play including a telephone settlement interview as follows:
    • negotiating and preparing the contract
    • preparing for settlement
    • settlement interview
    • report and bill to client
    • reflections
  • commercial leasing and mortgages assignment.
Workload There are no set contact hours. Students should expect to spend about 10 - 15 hours per week in reading and course related tasks to complete the course.

Eligibility Law degree or equivalent.
Corequisites Students enrolled in the Graduate Diploma of Legal Practice must complete the Skills for Practice course before beginning this course.

Indicative Reading List Reading lists are available through the course website in WebCT.
Technology Requirements This course makes extensive use of online technology for accessing resources, activities and assessment.  It is in your best interests to ensure you have a secure computer, preferably at home, where you can access all on-line information without restriction or difficulty.

If you intend using IT supplied by your employer, please be aware that you are likely to experience difficulties accessing key on-line resources due to firewall and security restrictions.

The computer you intend to use should meet the following minimum specifications.

When Offered and Delivery Mode:  This online 8 week course is offered twice a year in the 1st and 3rd teaching periods.

Classification in Graduate Studies Select:  Specialist. In addition an elective in the GDLP program, can be used as part of the articulation into the LLM and LLM (in practice) programs.
