Course Description

This course builds upon the concepts and ideas introduced in Australian Public Law and Commonwealth Constitutional Law. In 2010, the course will focus on Ch III of the Constitution - the federal judicial system. It will look at the separation of powers, and the implications that separation has for federal, State and Territory courts; the exercise of federal jurisdiction by federal, State and Territory courts and the law that is applicable when a court is exercising federal jurisdiction; and the jury trial requirements of s 80.

Learning Outcomes At the conclusion of this course, students will:
  • Have enhanced knowledge of the content and application of Australian constitutional law
  • Be able to place Australian constitutional law, its antecedents, and its debates in context with constitutional law issues in other jurisdictions
  • Apply legal history and social theory to an understanding of constitutional interpretation
  • Engage in depth a portion of the material through self-guided essay process
  • Be current in examination of bedrock issues in contemporary democracies, such as freedom of expression, legal approaches to terrorism, and constitutional approaches to equality rights, including the Bill of Rights debate.

It is anticipated that the course will be assessed by written assessment.
