Course Description

To provide the ADF Legal Officers' Special Career Structure (LOSCR) with the military operations law component of Legal Training Module 3.  This is the educational requirement for ADF Legal Officers to qualify for legal competency level LL4 under the LOSCR approved by the Defence Force Remuneration Tribunal.

A student who has successfully completed the course should show a sound knowledge of:

  • the ADF Rules of Engagement process at the strategic level and its relationship to the strategic planning process
  • the processes and framework for Australia's international engagement as relevant to the Defence Force
  • the process and constitutional law principles and issues of the Defence Force Aid to the Civil Power regime at the strategic level including State/Territory Federal relationships, consultative mechanisms and the role of strategic Command Division and the CDF
  • the higher level application of international law effecting the general obligations of the State as relevant to the ADF and the overall strategic management of ADF operations
  • the treat ratification process including in particular the ADF role and the formulation of National Impact Assessments
  • higher level United Nations processes and law
  • the international Status of Forces Agreement process and practice, including jurisdictional issues, and cross servicing arrangements
  • the role and potential impact of ADF Legal Officers at the strategic level in the formulation and development of state practice as part of the customary law regime.
Learning Outcomes

A participant who has successfully completed this course should:

  • have an advanced knowledge and understanding of the international law which applies to the use of force
  • have an advanced knowledge and understanding of the international law which applies to international and regional humanitarian operations
  • have a superior appreciation of the relevant provisions of international humanitarian law, especially the Geneva Conventions and Geneva Protocols, as they apply to contemporary aspects of military operations
  • have a superior appreciation of aspects of international law, international humanitarian law, and the law of the sea as they apply to military operations at sea
  • be able to make a superior contribution to class discussion, debate and analysis of seminar topics
  • be able to demonstrate superior research, analytical, and writing skills by completion of a major research paper.

Workload

Week long intensive seminar with on-line communication and activities before and after.

Required Skills
The course will be taught on the basis that you have completed Military Operations Law (LTM 2) at either the University of Melbourne or the Australian National University and that you have a sound understanding of principles and practice of international law as it applies to military operations.  You should also be familiar with relevant ADF policies as they relate to the use of force, and military operations.
Prescribed Texts There is no prescribed text book for this course.  Students will be provided in advance with Reading Materials which contain extracts of relevant readings.
